1. General Terms

Eligibility

• You must be at least 18 years old or of legal age in your country of residence to use the Platform.
• By registering, you confirm that all information provided is accurate, complete, and up to date.

Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Prohibited Use

You agree not to use the Platform to:

2. For Sellers

By registering as a Seller on StartSmartly.co, you agree to the following:

Content Ownership and License

• You retain ownership of your digital products.
• By listing on the Platform, you grant StartSmartly.co a non-exclusive, worldwide, royalty-free license to host, display, market, and distribute your digital goods to customers under the terms you specify.

Accuracy and Legality

• You are solely responsible for ensuring your listings, descriptions, and prices are accurate, truthful, and compliant with applicable laws, including copyright, consumer protection, and tax regulations.

Compliance

• Sellers must comply with all applicable EU and international laws, including:
  • The EU Digital Services Act (DSA)
  • The EU Digital Content Directive
  • GDPR for data processing and privacy protection

Payments and Fees

• Seller payouts are made according to our payment schedule, subject to applicable platform fees and payment processor charges.
• Sellers are responsible for declaring and paying any applicable taxes in their jurisdiction.

Refunds and Disputes

• Sellers must honor reasonable refund requests (e.g., defective files, non-delivery, or technical issues preventing use).
• Sellers must cooperate with StartSmartly.co and customers in dispute resolution.

Prohibited Content

• Uploading or selling copyrighted material without permission, harmful software, or illegal content will result in immediate suspension or termination.

3. For Customers

By purchasing products from StartSmartly.co, you agree to the following:

License to Use

• Upon purchase, you are granted a limited, non-exclusive, non-transferable license to download and use the digital product for personal or business use, unless otherwise stated by the seller.

No Resale or Redistribution

• Purchased digital products may not be resold, shared, or redistributed without the explicit written permission of the seller.

Refunds

• As per EU law, customers lose the right of withdrawal (i.e., 14-day refund period) once the download or streaming of a digital product has begun, unless the product is defective or not as described.
• Refunds are only available for defective, incomplete, or non-delivered products. Refund policies may vary by seller and will be clearly communicated before purchase.

Technical Requirements

• Customers are responsible for ensuring that their devices and software are compatible with the purchased digital products.

4. Data Protection & Privacy

• Personal data is processed in accordance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy.
• We only collect and process the data necessary to provide our services (e.g., account management, transactions, and communications).
• Customers and sellers have the right to access, correct, or delete their personal data at any time by contacting us.

5. Platform Liability & Disclaimer

• StartSmartly.co acts solely as an intermediary between sellers and customers.
• We do not guarantee the quality, legality, accuracy, or suitability of any digital product listed by third-party sellers.
• To the fullest extent permitted by law, StartSmartly.co is not liable for direct, indirect, or consequential damages arising from the use or inability to use products purchased through the Platform.

6. Termination

We reserve the right to:

• Suspend or terminate any account that violates these Terms, applicable laws, or intellectual property rights.
• Remove content that is unlawful or harmful.
• Terminate access to the Platform at our discretion, with or without prior notice.

7. Changes to Terms

We may revise these Terms from time to time. Updates will take effect upon posting to the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.

8. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law principles.
